Terms of Service for BuildersOnSite

These Terms of Service (“Terms”) govern your access to and use of the BuildersOnSite platform (“Service”) operated by BuildersOnSite LLC (“Company,” “we,” “our,” or “us”). By accessing or using the Service, you agree to these Terms.
1. Eligibility and Accounts
The Service is available to both businesses and individuals. Accounts may be created and managed by a general contractor, builder, or individual user (“Customer”).
Customers may authorize multiple users within their organization. Subcontractors may submit information (e.g., via QR code or other access methods) without creating an account. The Customer is solely responsible for all activity and data associated with its account and users, including subcontractor submissions.
2. Subcontractor Interactions
Subcontractors may provide information including, but not limited to, phone number, company name, personal name, images, text, and voice recordings. Subcontractors are not charged for use of the Service and are not required to create login credentials.
Customers are responsible for ensuring that any data collected complies with applicable laws and that appropriate notice and consent are obtained where required.
3. Acceptable Use
You agree not to:
Upload or share unlawful, harmful, or infringing content
Upload confidential or sensitive information where disclosure could cause harm
Attempt to interfere with, disrupt, or compromise the integrity or security of the Service
Circumvent billing systems or access controls
Reverse engineer, hack, or manipulate the Service
We reserve the right to suspend or terminate accounts for violations of these Terms.
4. Ownership and License to Data
Customers retain ownership of all data they upload or collect through the Service (“Customer Data”).
You grant BuildersOnSite a non-exclusive, worldwide, royalty-free license to use, store, process, and analyze Customer Data solely to:
Provide and operate the Service
Improve and develop features
Train and enhance system functionality
We may also use anonymized and aggregated data for analytics, benchmarking, and product improvement.
5. Fees, Billing, and Subscription Terms
The Service is offered on a subscription basis and may include a free trial period.
Subscriptions are non-cancellable for a minimum term of one (1) year
Subscriptions automatically renew unless cancelled in writing at least sixty (60) days prior to renewal
Payments are due on the 1st day of each month
A five (5) day grace period applies
Service may be suspended on the 6th day for non-payment
Continued non-payment may result in data deletion
Customers remain responsible for all fees owed under the agreement, even if the account is terminated early.
6. Service Availability and Disclaimer
The Service is provided on an “as-is” and “as-available” basis.
We use commercially reasonable efforts and industry best practices for hosting, security, and redundancy; however, we do not guarantee uninterrupted or error-free operation.
7. Third-Party Services
The Service may integrate with third-party providers, including hosting, messaging, analytics, and artificial intelligence services.
We are not responsible for the performance, availability, or practices of these third-party services.
8. Decisions and Reliance Disclaimer
BuildersOnSite does not verify the accuracy of data submitted through the Service.
You acknowledge that:
Information collected (including photos, text, and voice recordings) may contain errors or omissions
The Service may generate or transmit inaccurate or incomplete information
You are solely responsible for decisions made based on data collected, processed, or reported through the Service.
9. Audio and Recording Consent
You are responsible for ensuring that all individuals whose voice or likeness is captured through the Service have provided any necessary consent required by applicable law.
10. Limitation of Liability
To the maximum extent permitted by law:
BuildersOnSite shall not be liable for indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim shall not exceed the total fees paid by the Customer in the twelve (12) months preceding the claim
11. Termination
Customers may terminate their account at any time; however, subscription obligations remain in effect for the agreed term.
We may suspend or terminate access for:
Non-payment
Breach of these Terms
Fraudulent or abusive behavior
Upon termination:
Data will remain available for thirty (30) days
After 30 days, data may be permanently deleted
12. Intellectual Property
BuildersOnSite retains all rights, title, and interest in and to the Service, including all software, features, and branding.
No rights are granted except as expressly stated in these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved exclusively through binding arbitration in Idaho.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
